Voluntary Veterans’ Preference

Pursuant to Tex. Labor Code §§ 23.001 – 23.003, effective as of September 1, 2015, private employers may adopt a policy under which the employer may give a preference in employment decisions regarding hiring, promotion, or retention to a veteran over another qualified applicant or employee. Such policy must be in writing and applied reasonably and in good faith in employment decisions regarding hiring, promotion, or retention during a reduction in the employer’s workforce.

An employer may require an employee to provide appropriate documentation to establish that the employee is eligible for the preference.

Effective September 1, 2017, a private employer may provide notice to the Texas Workforce Commission or Texas Veterans Commission that it adopted a voluntary veterans’ preference. The commission will post a list on its website of each private employer with the preference.
